Terms of Use

These Terms of Use (the "Terms") govern access to and use of the Friio mobile application (the "Application") and the friio.io website, published by FRIIO, a SASU with share capital of 250 €, RCS Rouen 105 203 152, registered office at 72 Quai Cavelier de la Salle, 76100 Rouen ("FRIIO", "we", "us"). The terms of sale for paid subscriptions are set out in the Terms of Sale.

1. Acceptance

By downloading, installing or using the Application, you unreservedly accept these Terms. If you do not accept these Terms, do not use the Application.

2. Description of the service

Friio is an application that helps you manage the contents of your refrigerator, track expiry dates, share fridges with the people close to you, manage shopping lists and discover recipes tailored to what you have. The Application is provided "as is" and evolves over time.

3. User account

Using Friio requires creating an account (email + password, or Sign in with Apple / Google). You are responsible for the accuracy of the information you provide and for the confidentiality of your credentials. You must be at least 15 years old; below this age, use requires the authorization of the holder of parental authority.

4. Premium subscription

Certain advanced features are available through a paid "Premium" subscription (for example: creating multiple fridges and inviting members, unlimited scanning and recipes, advanced notifications). The exact features, prices and conditions are described in the Application and in our Terms of Sale. Subscriptions are sold and billed by the App Store (iOS) or Google Play (Android) depending on your platform.

5. User-generated content

The content you add to Friio (items, photos, notes, lists) remains your property. You grant FRIIO a non-exclusive, royalty-free license limited to the duration of your use of the service, for the sole purpose of storing, displaying and processing this content to provide you with the service (including sharing with the members of the fridges you choose).

6. Shared fridges

Friio lets you share a fridge with other users. The administrator of a fridge is responsible for managing its members and the shared content. Data added to a shared fridge is visible to all of its members. You undertake to invite only people who have consented to join a fridge.

7. Prohibited conduct

Using Friio for unlawful purposes or purposes contrary to public order
Attempting to access other users' data
Reverse-engineering, decompiling or altering the Application
Using the Application for commercial purposes without written agreement
Spamming, harassing or harming other users through the sharing features
Disrupting the operation of the service or circumventing technical limits

8. Availability and evolution of the service

FRIIO strives to ensure the availability of the service but does not guarantee uninterrupted or error-free operation. We may add, modify, suspend or remove features, in particular for reasons of maintenance, security or development. Significant changes will be announced to you.

9. Intellectual property

The Application, the website, their code, their original content, the "Friio" trademark and their graphic elements are the exclusive property of FRIIO and are protected by intellectual property law. No rights are transferred to the user beyond the right of personal use of the Application.

10. Limitation of liability

The expiry dates and alerts displayed by Friio are provided for purely indicative purposes and do not replace the manufacturer's information shown on the packaging. Always check the appearance, smell and condition of a product before consuming it. FRIIO cannot be held liable for the consequences of any food consumption.

To the extent permitted by law, FRIIO is not liable for any indirect damages, loss of data, loss of profit or harm resulting from the use of, or inability to use, the Application. Nothing in these Terms limits FRIIO's liability in the event of gross negligence, willful misconduct, or in cases where the law prohibits such limitation.

11. Personal data

The processing of your data is described in our Privacy Policy.

12. Account suspension and deletion

We may suspend or terminate your account in the event of a breach of these Terms. You may delete your account at any time, directly from the Application (details).

13. Changes to the Terms

FRIIO reserves the right to modify these Terms at any time, in particular to adapt them to changes in the service, in applicable legislation or in its practices. The applicable version is the one in force at the time you use the service.

In the event of a substantial change, we will inform you by an appropriate means (in-app notification or email) within a reasonable period before it takes effect. Continued use of the Application after the modified Terms take effect constitutes acceptance of them. If you do not accept the new Terms, you must stop using the Application and may delete your account at any time. The terms of sale for subscriptions are governed by the Terms of Sale.

14. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and failing amicable resolution, the French courts have jurisdiction, subject to the protective rules applicable to consumers. The mediation and complaint procedures relating to subscriptions are set out in the Terms of Sale.
